The National Prosecuting Authority (NPA) will return to the Gqeberha High Court to argue for leave to appeal the acquittal of Timothy Omotoso and his co-accused.
Omotoso, a Nigerian televangelist, and his co-accused, Lusanda Solani and Zikiswa Sitho, were acquitted of charges of rape and human trafficking earlier this year.
Judge Irma Schoeman ruled that the state had failed to prove its case beyond a reasonable doubt, citing poor cross-examination, weak witness management, and procedural missteps by the prosecution.
The case, which began in 2017, involved allegations that Omotoso used his position as a religious leader to exploit young women at his Jesus Dominion International Church in Durban.
The NPA will argue for leave to appeal the acquittal on Monday.
